A Guardianship is a legal process whereby the Probate Court appoints a trusted individual (the guardian) the power to make medical, personal and/or financial decisions for another (the protected person) when someone is unable to manager their own affairs. Less Restrictive Alternatives: In some cases, guardianship may not be necessary. There are several less restrictive options available, including durable powers of attorney, representative payees, trusts, and health care powers of attorney. These tools can allow a trusted individual to assist with financial or medical decision-making without court involvement and may help avoid or delay the need for a guardianship. Our office works closely with clients to explore these options, evaluate what is available based on the individual’s circumstances, and determine the most appropriate course of action. It is important that these documents are properly executed while the individual still has the legal capacity to do so.
